Marran Run Titled Lot Promotion (‘Promotion’)
Promotion Details
1. 135 Barry Road Pty Ltd (ACN 652 847 419) as trustee for the 135 Barry Road Trust (‘Barry Road Pty Ltd’) proposes to offer buyers the following promotion during the Promotion Period on accordance with these terms and conditions.
2. The Promotion runs from 27th July – 15th September 2024 (‘Promotion Period’).
3. The Selected Lots will include 109, 111, 118, 119, 122, 125, 132, 146, 150, 153, 154, 103, 126, 116 in the development known as Marran Run (‘Selected Lots’).
4. The Promotion is only valid for Eligible Participants (as defined below) during the Promotion Period, and is correct as at the time of publication, but may change at Barry Road Pty Ltd’s absolute discretion at any time including during the Promotion Period.
Eligibility
5. Purchasers of the Selected Lots in stage 1 of the development known as Marran Run that enter into a Land Contract (‘Land Contract’) for a Selected Lot during the Promotion Period (‘Eligible Participants’) that comply with these terms and conditions will be eligible to:
a. receive a $60,000 cash rebate from Barry Road Pty Ltd at settlement under a Land Contract for a Select Lot if the purchaser strictly complies with these terms and conditions and effects settlement under the Land Contract on time and within 30 days of the day of sale set out in the Land Contract for a Selected Lot (Settlement Rebate); or
b. receive a $50,000 cash rebate from Barry Road Pty Ltd at settlement under a Land Contract for a Select Lot if the purchaser strictly complies with these terms and conditions and effects settlement under the Land Contract on time and within 45 days of the day of sale set out in the Land Contract for a Selected Lot (Settlement Rebate); or
c. receive a $40,000 cash rebate from Barry Road Pty Ltd at settlement under a Land Contract for a Select Lot if the purchaser strictly complies with these terms and conditions and effects settlement under the Land Contract on time and within 60 days of the day of sale set out in the Land Contract for a Selected Lot (Settlement Rebate); or
d. receive a $20,000 cash rebate from Barry Road Pty Ltd at settlement under a Land Contract for a Select Lot if the purchaser strictly complies with these terms and conditions and effects settlement under the Land Contract on time and within 90 days of the day of sale set out in the Land Contract for a Selected Lot (Settlement Rebate).
6. In order to be eligible for the Settlement Rebate:
a. the Eligible Participant must enter into a binding Land Contract during the Promotion Period (Eligible Lot);
b. the Eligible Participant must pay the deposit specified in the Land Contract in accordance with the terms of the contract (time being of the essence);
c. the Eligible Participant must cause the contract to become unconditional as to any matter within the Eligible Participant’s control (including but not limited to the Eligible Participant obtaining unconditional finance approval and FIRB approval (if applicable)) in relation to the acquisition of the Eligible Lot; and
d. the Eligible Participant must effect settlement under the Land Contract for the Eligible Lot in accordance with the terms of the contract (time being of the essence) without any delay.
Exclusions
7. The following parties are excluded from being deemed a Eligible Participant for the purposes of the Promotion:
a. any agents acting on behalf of Barry Road Pty Ltd or related parties of Barry Road Pty Ltd;
b. purchasers that have previously entered into a contract to purchase a lot at Marran Run;
c. if there is more than one purchaser of a Selected Lot, only one purchaser will be an Eligible Participant.
8. Only Settlement Rebate will be given by ‘Barry Road Pty Ltd’ in respect of any Eligible Lot regardless of the number of purchasers entering to the Land Contract for an Eligible Lot.
9. Any duties, taxes, levies or charges which may be payable as a consequence of receiving the Settlement Rebate are the sole responsibility of the recipient thereof.
10. The Settlement Rebate is subject to these terms and conditions and is not transferable, nor redeemable or exchangeable for monetary payment or a discount or rebate on the purchase price of an Eligible Lot unless agreed to by Barry Road Pty Ltd (at its absolute discretion).
11. In the event of any dispute as to eligibility for the Promotion, including a decision by Barry Road Pty Ltd to offer a Settlement Rebate to an Eligible Purchaser who may not otherwise be eligible for the Promotion, eligibility will be determined by Barry Road Pty Ltd and Barry Road Pty Ltd’s decision will be final and binding.
12. Eligible Participants acknowledge that if they receive a Settlement Rebate they:
a. are bound by all terms and conditions relating to the Settlement Rebate and the Promotion;
b. agree not to make any claim or objection against Barry Road Pty Ltd; and
c. if required by law, will disclose the Settlement Rebate to its financiers, relevant authorities and government agencies.
General Terms of the Promotion
13. Barry Road Pty Ltd will not be liable for any loss or damage suffered or incurred by any person who relies upon the information in any advertisement relating to the Promotion or participates in the Promotion except for any liability which cannot be excluded by law, nor for any restriction of Barry Road Pty Ltd’s ability to provide any aspect of the Promotion as a result of the act of any third party, its employees or agents.
14. Barry Road Pty Ltd may cancel or make changes to the Promotion at any time without notice. Such changes may include adding or withdrawing Eligible Lots or shortening or extending the Promotion Period.
15. These terms and conditions supersede any prior terms and conditions for the Promotion.
Privacy
16. Barry Road Pty Ltd collects personal information in order to conduct the Promotion, to assist in providing the products or services an individual has requested (if any), and to improve its products and services. Barry Road Pty Ltd may use the information for promotional, marketing, publicity, research and profiling purposes, and may be in touch by any means (including telephone, email or SMS) at any time to let an individual know about products, services or promotional activities which may be of interest until the individual informs Barry Road Pty Ltd otherwise.
17. Barry Road Pty Ltd may also share individuals information with other persons or entities who assist it in providing its products or services or running competitions or trade promotions. Barry Road Pty Ltd may also disclose personal information to third parties as required by Australian regulatory authorities.
18. Barry Road Pty Ltd is bound by the National Privacy Principles in the Privacy Act 1988 (Cth), and by participating in the Promotion, each individual is taken to consent to Barry Road Pty Ltd’s privacy policy.
YOURLAND “MARRAN RUN BUILDER REFERRAL” PROMOTION
TERMS AND CONDITIONS
1. The Promotion
1.1 These terms and conditions (Terms and Conditions) apply to a promotion being offered by the Promoter. The Promoter is Yourland Management Pty Ltd ACN 151 294 852 (Promoter).
1.2 By participating in the Marran Run Builder Referral Promotion (Promotion), you are deemed to have read and accepted these Terms and Conditions. If you do not agree with these Terms and Conditions, you cannot participate in the Promotion.
1.3 The Promotion commences on 20 July 2024 at 9:00am AEST and closes upon the earlier of:
1.3.1 5:00pm AEST on 15th September 2024; or
1.3.2 when 5 Referees have satisfied the requirements of Term 3.1.3;
(Promotion Period).
1.4 The Promotion is available on select lots in stage 1 at the Marran Run Estate as determined by the Promoter at its absolute discretion ( Marran Run Lot).
1.5 Subject to these Terms and Conditions, a registered builder who refers a purchaser that settles their purchase of a Marran Run Lot, will be eligible to receive a VISA Gift Card for the value of $20,000.00 (Promotion Benefit).
2. Conditions of Entry
2.1 Employees, directors and other representatives of the Promoter and its related bodies corporate are ineligible.
2.2 Incomplete entries may be deemed to be invalid at the discretion of the Promoter.
2.3 There is a limit of one (1) entry per person, per purchase.
2.4 The Promoter is not responsible or liable for any attempted entries that are not received for any reason, illegible entries, incorrect transcription of entry information, technical failures of any kind in relation to entry to the Promotion, the unavailability of any service in relation to entry to the Promotion, third party interference and technical or human error in relation to the administration of the Promotion. Late entries will not be accepted.
2.5 By signing and delivering the Application Form in accordance with clause 3.1 of these Terms and Conditions, you and the Referee agree to these Terms and Conditions.
2.6 If more than one individual is listed as the purchaser in the Contract of Sale, this is deemed to be one entry for the purpose of the Promotion.
2.7 Participation in the Promotion is open to individual and entity participants, participation is only available to individuals who are over 18 years of age and residents of Australia.
2.8 Unless otherwise agreed by the Promoter, a participant is not eligible to receive the Promotion Benefit on more than one Contract of Sale.
2.9 The Promotion can be used in conjunction with other public offers or promotions being offered by the Promoter.
3. Eligibility
3.1 To participate in the Promotion:
3.1.1 you must complete in full (including your details and the individual’s details that you are referring (Referee)) and deliver the attached referral application form (Application Form) to the Marran Run Sales Team by way of email to hello@marranrun.com.au prior to the end of the Promotion Period; and
3.1.2 you must be an authorised representative of a registered builder within the State of Victoria at the time of making the referral.
3.1.3 The Referee must:
3.1.3.1 have signed a contract of sale of land (in the form to be provided by the Promoter) for an Marran Run Lot (Contract of Sale), paid the full deposit payable under the Contract, and have that contract become unconditional prior to the end of the Promotion Period;
3.1.3.2 have completed the cooling off period under the Contract of Sale prior to the end of the Promotion;
3.1.3.3 comply with all terms and conditions set out in the Contract of Sale at all times prior to settlement;
3.1.3.4 complete settlement in accordance with the terms and conditions set out in the Contract of Sale; and
3.1.3.5 not already exist on the Marran Run database at the time of the referral.
4. Promotion Benefit
4.1 If you meet the eligibility requirements set out in these Terms and Conditions, the Promoter shall provide you with the Promotion Benefit.
4.2 The Promoter shall arrange for the Promotion Benefit to be provided to you within 60 days of settlement of the Contract of Sale.
4.3 The Promotion Benefit will at all times remain subject to these Terms and Conditions.
4.4 The Promotion Benefit is not redeemable for cash and shall only be applied in the manner set out in these Terms.
4.5 Despite any term to the contrary, if the Referee does not do all things reasonably necessary to effect settlement of the Contract of Sale on the original settlement date as defined in the Contract of Sale, you will not be eligible to receive a Promotion Benefit.
5. General
5.1 By signing and returning the Application Form, you and the Referee agree to the Terms and Conditions.
5.2 To the extent permitted by law, the Promoter excludes all liability for any personal injury, loss or damage in any way arising as a result of receiving the Promotion Benefit or any aspect of the Promotion Benefit.
5.3 The Promoter expressly denies and excludes all representations about the Promotion and Promotion Benefit, except as set out in these Terms and Conditions.
5.4 The Promoter reserves the right to vary the Promotion Period at without liability to any participant or other person, subject to applicable laws.
5.5 The Promoter reserves the right to vary the terms of, or cancel, the Promotion at any time without liability to any participant or other person, subject to applicable laws. The eligibility of participants to participate in the promotion is solely within the discretion of the Promoter.
5.6 The issuer of the VISA cards has its own terms and conditions governing the use, expiry, and transferability of the gift card. The Promoter makes no warranty as to the terms contained in the issuer’s policies. Participants must make their own enquiries with the issuer of a Visa card.
5.7 Once a Visa card is provided in accordance with these Terms and Conditions, the Promoter is not responsible for the expiration or cancellation of a Visa card.
5.8 Visa cards are subject to availability. The Promoter reserves the right to amend, withdraw or substitute the Visa cards in the event of any unforeseen circumstances outside its reasonable control.
5.9 To the extent permitted by law, the Promoter excludes all liability for any personal injury, loss or damage in any way arising as a result of entry or participation in the Promotion or receiving the Promotion Benefit.
5.10 The Promoter will collect personal information to conduct the promotion in accordance with the Promoter’s Privacy Policy which is available here.
Terms and Conditions – CORE Projects Rental Appraisal
Rental Appraisal Provided By: The rental appraisal is provided by Core Projects Pty Ltd (Core Projects) and is dated 17th May 2024.
Nature of Rental Appraisal:
The rental appraisal refers to the likely expected leasing price of the property.
It is not a guaranteed rental price and is subject to change without notice.
Properties Covered:
The rental appraisal applies to lots 115-120 at Marran Run Estate, Thomastown.
The appraisal is specifically for properties with 4 bedrooms, 2 bathrooms, and 1-car garage.
Conditions:
The rental appraisal is based on the property being offered under the prevailing conditions with a twelve-month lease.
